The Litigation Counsel will function as a pro-active corporate and business partner to provide litigation advice and manage litigation, with particular emphasis on FMC’s portfolio of legacy asbestos litigation. The role will report to the Assistant General Counsel Environmental, as well as, will work with others in the Law Department
Duties will include, but not be limited to:
Management of Asbestos Litigation
Manage outside counsel on all asbestos cases nationally
Develop and manage multi-million dollar annual budget and report quarterly accruals
Oversee individual and overall case defense strategy and evaluations for settlement
Primary contact with outside counsel regarding corporate records, and product/plant/business history
Review and approval of outside counsel billings
Report on cases to management and oversee reports to insurance carriers
Support insurance recovery efforts
Manage intake of new asbestos cases
Direct workload of paralegal and administrative staff dedicated to asbestos litigation
Management of US Litigation
In coordination with in-house business and specialist counsel, provide strategic advice regarding US litigation and arbitration – commercial, IP, employment, and other (as assigned).
Manage, develop and update US litigation management policies/procedures, including
service of process procedure
issue document holds and manage FMC’s compliance with discovery and records preservation obligations.
E Discovery – serve as in-house expert on applicable procedural rules regarding document preservation and disclosure; select and manage outside E Discovery vendors; responsible for coordinating document collections; take the lead on procedures
Partner with US based business counsel on all non-litigation claims (crop and non-crop businesses) – training on claims avoidance and management, settlement procedures, and data/trend review
Corporate General Litigation Support
Coordinate and prepare, for FMC General Counsel, semi-annual report of significant litigation matters to be delivered to FMC’s Board of Directors
Coordinate with Regional Business Counsel on quarterly Global litigation review and liability reserve process
Law Department contact for insurance and risk management team for all US claims requiring in-house legal support (e.g., workers comp, auto, property)
Responsible for insured case management and communications
Toxic Tort Claims Review – quarterly meeting
Self Insurance Reserve review – quarterly meeting
Ensure reporting of settlements to Medicare undertaken
Responsible for responding to US subpoenas, and records requests for records under OSHA
FMC Records Retention Policy – Law Department expert on the policy; accountable for recommending changes to policy, managing training, and advising on records preservation or destruction upon organizational change events (e.g., site closure)
Law Degree from an Accredited US Law School
Active Bar Membership – PA Preferred
5 to 10 years experience in litigation -- background in asbestos, personal injury or environmental litigation preferred
E-Discovery – deep experience understanding applicable rules, preservation software, etc.
Experience in chemical\life sciences sectors preferred
Experience in a corporate or government law department preferred
Excellent written & oral communication skills
Results oriented individual with ability to work under pressure
Ability to work independently, handling multiple projects and priorities within deadlines
